MOTION TO TERMINATE SEX OFFENDER REGISTRATION PURSUANT TO PC 29O
PURSUANT TO PEOPLE V. HOFSHEIER, (2006) 37 Cal.4th 1185
For individuals convicted of a registerable offense in the State of California, the PC 290 sex offender registration requirement can be the equivalent of a "life sentence" in that the defendant is required to abide by very strict guidlines forcing the individual to register for the rest of his life as a sex offender or face subsequent criminal charges and prosecution.
New case law, as set forth in the case of People v. Hofsheier, has established that certain individuals may be eligible to have their PC 290 registration requirement permanently terminated on the legal basis of a violation of Due Process of the Law. A formal Court hearing is required, normally in the County where the offense occurred to determine whether or not the individual is eligible for termination of the registration requirement.
Additionally, some individuals may be eligible to have their information excluded from the Megan's Law Internet Website by filing a petition through the Department of Justice.
